Hey folks,
I ran into a question a few weeks ago and wasn't able to find an answer, I was wondering if any of you have had similar experiences or could offer any advice. First, here's the details:
I recently took some shots of the Lunar New Year celebrations in Ottawa's Chinatown (http://www.flickr.com/photos/banerixat/sets/72157625992173298/). After doing some quick post-processing, I tossed them up on my flickr page and was pleasantly surprised to find out shortly there after that two of our rather high-traffic local blogs were interested in using my photos.
Any of the pics that I post publicly on flickr I license under a Creative Commons licence (http://creativecommons.org/licenses/by-nc-sa/2.0/). I'm thrilled if someone likes my shots enough to use them, and I've added a little tag to them all so if it gets some exposure, so much the better. Once I'm a world famous photographer maybe I'll start charging millions for every shot, but for now, this works just fine.
One of the two bloggers who used my pics wrote me and asked me if he could. I told him to feel free. The other didn't. Neither needed to given that the pics were licensed under the CC. However, the second blogger copied all of my pics to their own profile on flickr, which technically they were also allowed to do, though they didn't attribute each individual photo, only the entire set. Furthermore, the CC license they applied wasn't the same criteria which I had original released the photos under.
My questions are this: 1) Are they required to credit each pic individually? 2) Am I right in assuming they aren't allowed to re-issue a new CC licence given that's one of the stipulations in my original CC licence?
Don't worry, I'm not looking for legal advice, none of this was really a big issue for me. To be honest, I was pretty thrilled people liked the shots enough to use them. I was curious what others would think of the situation.
